Sale of Goods:

The following are the terms and conditions for the sale of goods by 'LumiSafe Ltd'. It is important that you read and understand these terms before ordering from us. LumiSafe Ltd may change this policy from time to time by updating this page.

 

Purchasing:

The contract between us will be formed once we confirm to you acceptance of your order. We will do this by an 'in process' or 'acceptance' email, prior to then we will be under no obligation to supply you with the goods you have ordered. The user is responsible for ensuring that any email address is in working order and must assume the risk of all email receipts and/or operational failures.

 

Price:

The price shall be the amount quoted on the website except when we make an error or if the price has changed since the webpage publication. If we have made an error, then we will inform you, via email, of this as soon as possible after you have placed your order. We will tell you the correct price and ask you if you still wish to place your order with us. If we have not heard back, via email, from you within 10 days, then we will presume that you did not want to place your order again with us and we will give you a full refund if you have already paid. There is a mandatory £10.00 (Ex.VAT) minimum order limit across the website. (Sub Total) The checkout system will not allow any orders below this limit. You will be unable to proceed to payment.
 


Payment and Delivery Address:

Payment for goods can be made securely via our website using the 'commonly recognised payment system' 'Paypal'. This system accepts credit/debit cards based on your personal accounts with the providers. Delivery will be to the address given to us by you or your payment provider at the time you place your order. Delivery will only be dispatched when cleared funds have reached our accounts. Although unlikely, please allow up to a maximum of 30 days for delivery.
 

UK Customers.

Costs for UK delivery are FREE.
Please note: FREE delivery in the UK is only valid for goods ordered and purchased via the LumiSafe Ltd website ordering/payment systems. Prior LumiSafe Ltd agreement is required for the following types of purchase:
  • Pro-forma invoices
  • Purchase Orders
  • Credit Orders
Full delivery and/or other possible charges will be applied to these types of orders. Please contact us via email to discuss these types of orders/purchase.
 

EU Customers.

Delivery costs are calculated in the checkout system based on the checkout sum total. Delivery to EU locations uses a ‘tracking’ provision. Delivery estimate is to be between 5-10 days. EU customers will be expected to ensure that goods are able to be delivered at the location supplied and someone is there to sign for the goods.

EU customers, either VAT registered or non VAT registered, buying via the online checkout system will have to pay full UK VAT and postage costs. However, if you are a VAT registered EU customer, entitled to be zero rated under the EU VAT system, please contact us, via email, with your potential order, VAT number (for checking), delivery address and full contact details. We are able to electronically send you your order, once checked and authorised for zero VAT, with an electronic payment instruction. Once paid, goods will be dispatched.

You should also be aware that there may be local custom/import/VAT charges to be paid by you the customer when the goods arrive at the delivery location/or port of entry. LumiSafe Ltd is NOT responsible for these charges.

Prior LumiSafe Ltd agreement is required for the following types of purchase:
  • Pro-forma invoices
  • Purchase Orders
Full delivery and/or other possible charges will be applied to these types of orders.


Overseas/Rest of the world.

Overseas/rest of the world, MUST contact us, via email, with your potential order, delivery address and full contact details. We are able to electronically send you your order, once we have checked and authorised it, with an electronic payment instruction.

Goods/orders authorised for overseas/rest of world delivery will not have to pay UK VAT. However, Rest of the world postage costs will apply, you will be advised what these are before payment is taken. You should also be aware that there may be local custom/import/VAT charges to be paid by you the customer when the goods arrive at the delivery location/or port of entry. LumiSafe Ltd is NOT responsible for these charges.
 

Incorrect order/delivery information.

Should we receive an EU order via the online system, using the UK delivery provision, but addressed for EU/overseas we will place it 'on hold'. We will attempt to contact you to pay the correct charges before acceptance/fulfilment of the order. Failure will result in the order being cancelled.

Should we receive an overseas/rest of the world order via the online system, using the UK or EU delivery provision, but addressed for overseas/rest of the world we will place it ‘on hold’. We will attempt to contact you to pay the correct charges before acceptance/fulfilment of the order. Failure will result in the order being cancelled.

 

Availability of Goods:

Availability of goods is controlled via the website listings. You will be unable to add the product to the basket if there is 'nil' stock available. Any shortages in supply will be automatically changed in the basket item total in the checkout area should you try to order more than the stock level.

Should this fail, we will contact you on receipt of order to advise you of stock level and any delivery delays.

 

Cancellation and Return:

Should you wish to cancel your order prior to dispatch then email us as soon as possible with your order details (see 'contact' pages on the website). Once cancelled, refund of any sums paid by you will be reimbursed as soon as possible or within 30 days.

After dispatch and not later than 7 (seven) working days following the day that the goods are/were delivered to you, you may cancel and return the goods as follows:

You are under a duty (until the goods are returned to us) to retain possession of them and to take reasonable care of them. Goods must be returned to us in 'as-new' condition in original unopened packaging. Re-stocking costs may apply should any packaging be damaged on return. Where you cancel your order after dispatch, the goods must be returned to us at your cost. Refund of any sums paid by you for your order will be reimbursed as soon as possible or within 30 days after receipt and inspection of the goods at LumiSafe Ltd. There will be no reimbursment of costs incurred by you for return of goods.

 

Delivery Terms:

LumiSafe Ltd will attempt to deliver your goods as soon as possible. Any dispatch times/dates shown on our website are for estimation/information only and do not guarantee a delivery date from us. If we are not able to deliver your order in a reasonable time, then we will inform you and you may, if you wish, cancel the contract and we will fully reimburse you. LumiSafe Ltd will not be under any liability to you for any delay or failure to deliver if the same is wholly or partly caused directly or indirectly by circumstances beyond our reasonable control.

You are responsible for ensuring that a responsible party is available at the delivery address to sign for and/or take delivery of the goods. In cases where a delivery has not been possible due to a lack of signatory, additional charges may be applied for additional delivery attempts.

You must inspect the goods at delivery and advise us if the delivered goods are not what you ordered or are faulty. Where goods are delivered by courier or registered/signed for post, once signed for, responsibility for those items is passed to the signatory. Please check thoroughly all packages and their contents before signing for them.
 


Loss and Damages:

We will not be liable under our agreement with you for any loss or damage caused by us or our employees or agents in circumstances where:

There is no breach of a legal duty of care owed to you by us, or by any of our employees or agents.
Such loss or damage is not a reasonable foreseeable result of any such breach.
Any increase in loss or damage results from breach by you of any of these terms.
LumiSafe Ltd shall not be deemed responsible for indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by you and us (such as loss of profits or loss of opportunity)

As a consumer, you have certain rights by law regarding the return of 'defective' goods and claims in respect of losses caused by any negligence on our part or our failure to carry out our obligations. These terms and conditions shall not affect those rights.
